Terms of Service

Last updated: October 28, 2026.

These Terms govern the DigitizeCanada website, account, and AI Receptionist services provided by 9478-4014 Québec inc., doing business as DigitizeCanada (“DigitizeCanada,” “we,” “us,” or “our”). Our website is https://www.digitizecanada.ca. Contact us at contact@digitizecanada.ca.

1. Accepting these Terms

By creating an account, purchasing a plan, or using the service, you agree to these Terms and our Privacy Policy. If you use the service for a business, you confirm that you are authorized to bind that business. You must be at least 18 years old and able to enter a contract.

2. The service

AI Receptionist handles inbound calls using the setup details and instructions you provide. Depending on your selected plan and settings, it may screen calls, take messages, generate summaries or transcripts, and send notifications through channels you configure. Features, included minutes, prices, and taxes are those shown at checkout and in your account.

3. Your responsibilities

You are responsible for the accuracy and lawfulness of your account, business information, greeting, instructions, call-forwarding configuration, and contact destinations. You must have authority to direct calls to the service and to provide the information you submit. You are responsible for reviewing setup details and outputs before relying on them.

You must provide callers with any notices and obtain any consents required by applicable law before calls are forwarded, processed, transcribed, summarized, or recorded. Do not submit payment-card data, passwords, authentication codes, or sensitive personal information unless the service specifically requests it and you have a lawful basis to do so.

4. Acceptable use and emergency limitations

The service is not designed or intended for emergency services, emergency dispatch, alarm monitoring, crisis response, medical triage, or any use where a delay, missed call, or inaccurate response could threaten life, health, or safety. Do not rely on it to contact emergency services or guarantee emergency assistance. Callers facing immediate danger should contact local emergency services directly.

You may not use the service to break the law, deceive or impersonate others, harass or threaten people, send unlawful spam or marketing calls, violate privacy or recording laws, infringe another person’s rights, interfere with networks or security, bypass usage limits, or transmit malicious code. We may restrict or suspend use that creates legal, safety, security, or operational risk.

5. Automated call handling and service limitations

Responses, call screening, transcripts, and summaries may be incomplete, inaccurate, delayed, unavailable, or misunderstood. The service does not replace your professional judgment, staff, or review of important messages. You remain responsible for decisions and follow-up based on calls or generated content.

We work to provide a useful service, but do not promise uninterrupted or error-free operation, that every call will connect or be handled, that every notification will arrive, or that generated content will be accurate or suitable for a particular purpose. Service depends on internet, telephone, hosting, and processing systems that can be affected by outages, maintenance, congestion, or events outside our reasonable control.

6. Calls, recordings, transcripts, and third-party services

To deliver call handling, call information may be transmitted to independent communications, hosting, and processing providers. Calls may be transcribed or summarized, and a provider may create or retain an audio recording under its own systems, settings, and terms. DigitizeCanada does not store the audio file itself in its call-history record. Our account records may store call details, transcripts, summaries, and links to recordings supplied by providers. We do not control a provider’s recording or its retention period. See our Privacy Policy for information about data handled by DigitizeCanada.

We rely on independent providers to support parts of the service. Their systems, availability, and independent data-retention practices may be outside our direct control. We take reasonable steps within our role, but cannot guarantee a provider’s uninterrupted service or practices. This does not exclude responsibilities that applicable law does not allow us to exclude. You must review relevant provider notices and ensure your use of the service and caller notices comply with applicable law.

7. Plans, trials, minutes, and notifications

Plan prices are charged in Canadian dollars at the rate shown at checkout, plus applicable taxes. Subscriptions renew monthly until cancelled. Included minutes and other plan limits are shown on the pricing and checkout pages and in your account.

An eligible customer who has not previously used a trial may receive a 14-day trial with a card on file, limited to 30 call minutes. If you are eligible, the selected paid plan normally begins on day 15 and its monthly allowance starts then. If you are not eligible for a trial, the paid plan begins at checkout.

Your dashboard includes a setting to start the paid plan automatically when the 30 trial minutes are exhausted. If enabled, paid service may begin and billing may start before day 15. If disabled, call handling may pause when trial minutes run out unless you start a paid plan yourself. You can manage this setting in your dashboard. If you do not cancel an eligible trial before it ends, the selected paid subscription is scheduled to begin when the trial ends.

We may send low-minute alerts when usage reaches about 80% of an allowance, through the email, text, or app channels you configure. Alerts are best-effort only. Delivery can fail or be delayed because of network, provider, device, server, or other technical issues. You remain responsible for checking your account, monitoring usage, and managing paid-start and overage settings.

If you enable automatic overage, additional usage may be billed in 10-minute blocks at the rate shown in your account (currently CAD $10 per block, plus applicable taxes). If automatic overage is not enabled and no minutes remain, call handling may pause until coverage is restored.

8. Cancellation

You may cancel from your dashboard. Cancellation of a paid subscription takes effect at the end of the current paid month; the service and assigned number may remain active until then. At the end of that period, the service is deactivated and the assigned number may be released. To avoid the first paid charge for a trial, cancel before the trial ends.

9. Account security and suspension

You are responsible for safeguarding your account access and notifying us promptly if you believe it has been compromised. We may suspend or limit access when reasonably necessary to protect people, the service, or systems; address suspected misuse, non-payment, security issues, or legal requirements; or investigate a material breach. Where appropriate and permitted, we will provide notice and an opportunity to resolve the issue.

10. Disclaimers and limits of responsibility

To the maximum extent permitted by law, the service is provided on an “as available” basis, without guarantees that cannot be supported by its technical nature, including guarantees of uninterrupted availability, successful delivery of every call or alert, or error-free automated output. Nothing in these Terms removes consumer rights or other legal protections that cannot lawfully be waived.

To the maximum extent permitted by law, DigitizeCanada is not liable for indirect, incidental, special, consequential, exemplary, or punitive losses, or for lost profits, business opportunities, or goodwill arising from use of or inability to use the service. This section does not limit liability that applicable law does not permit us to limit, or your rights under non-waivable law.

11. Changes to the service or Terms

We may update the service or these Terms. We will post the current Terms here and update the date above. For material changes, we will provide notice through the account or contact information on file when reasonably practicable or when required by law. Continued use after a change takes effect means you accept the updated Terms to the extent permitted by law.

12. Governing law and contact

These Terms are governed by the laws of Québec and the applicable laws of Canada, subject to mandatory consumer-protection rules that apply to you. Disputes will be handled by the courts with jurisdiction under applicable law.
